Student Denied College Admission Because of His Faith

ACLJ Files Lawsuit On Behalf of Student Denied College Admission Because of His Faith
Pray

Late yesterday afternoon, ACLJ filed a lawsuit on behalf of Brandon Jenkins against officials of The Community College of Baltimore County (CCBC) in Maryland for denying Brandon admission to its Radiation Therapy Program in part due to his expression of religious beliefs. As one faculty member explained to Brandon, on behalf of CCBC, the “field [of radiation therapy] is not the place for religion."
Brandon first applied for admission to the Radiation Therapy Program in April 2013. He met the standards of a competitive candidate and scored the maximum points allowed during his observation. During the interview process, college officials asked Brandon, “What is the most important thing to you.” Brandon answered simply, “My God.”

Brandon was denied entry into the program. After Brandon inquired why he was denied, the Program Director, Adrienne Dougherty, told him:

I understand that religion is a major part of your life and that was evident in your recommendation letters, however, this field is not the place for religion. We have many patients who come to us for treatment from many different religions and some who believe in nothing at all. If you interview in the future, you may want to leave your thoughts and beliefs out of the interview process.

Brandon made several attempts to address with Defendants the discriminatory reasoning upon which they denied his admission to the program. In response to a letter from the ACLJ outlining CCBC’s retaliation, CCBC defended Director Dougherty’s comments to Mr. Jenkins suggesting that such comments were merely intended to advise Brandon that "he not wear them [his religious beliefs] on his sleeve," and “[s]tated bluntly, that is not bad advice.”
Since Director Dougherty’s comments, CCBC has attempted to provide additional reasons for Brandon’s non-admission to the Program. Nonetheless, despite persistent denial by CCBC of unfair treatment, CCBC acknowledges that Brandon lost points during the interview process because Brandon allegedly stated that he was pursuing a career in radiation therapy at the behest of God. This, CCBC asserts, was not “the best answer.” CCBC further stated, "[c]andidates who describe thoughtful considerations about what the candidate will contribute as an individual to patients and the advancement of care make far better therapists than those who are told by others [God] to pursue the field. . . the fact is that in any secular job or program interview it is better to have a concrete reason for wanting to undertake the training at hand than to say only that God directed one to do it."

The lawsuit, filed in federal court in the district of Maryland in Baltimore, names a number of school officials as defendants. The complaint requests the court to declare that the actions taken by CCBC officials violated Brandon’s First Amendment rights and that defendants be prohibited from further retaliating and/or discriminating against Brandon based on his religious views and/or his expressions thereof. Further, the suit requests an injunction requiring CCBC to admit Brandon to the Radiation Therapy Program.

The ACLJ is defending religious freedom on campus from coast to coast. Last month, ACLJ attorneys won a jury verdict on behalf of a Christian conservative professor denied a promotion because of his free speech. Also last month, the ACLJ successfully defended a Christian campus ministry from attempts to prohibit the use of faith-based criteria in its hiring decisions.

AFRICAN CURRICULUM FOR AMERICAN STUDENTS

By Chuck Ross -

Chicago public schools are set to introduce a new Afro-centric curriculum, according to a closely-guarded copy obtained by The Daily Caller News Foundation.

The curriculum covers kindergarten through tenth grade and is designed to align with Common Core. It includes a web link to TheAfrican.com, a website whose publisher decries “fake-Jews” and calls the United States a “Zionist-occupied enemy territory.”

The site also claims that the world will end sometime this year and that President Barack Obama is “merely another trick of [the beast of the 4th Kingdom].”

The new Chicago curriculum was announced last December.

“CPS has taken great pride in developing a yearlong, interdisciplinary African and African-American studies program that will enrich the understanding and appreciation of African and African-American history and culture to help build stronger and more cohesive student communities,” said Chicago Public School chief executive Byrd Bennett in an announcement of the curriculum, dubbed IAAAS.

CPS began developing IAAAS after a push last year from groups that wanted to implement a state law passed in 1990 that required public schools to offer one unit on African-American history.

But CPS went above and beyond, implementing the curriculum across all core disciplines, which include literacy, mathematics, science, social science, the arts, physical education and health.

California: Protecting sexual integrity of boys would disqualify you as a judge

The Gay Gestapo has made a big-time move in California. If you're a judge in that state and you happen to be a fan of sexual normalcy and want impressionable young teens to be protected from sexual predators, your professional career in the law could be over.

While the Boy Scouts of America have foolishly and uselessly allowed homosexuals to become scouts, they have drawn the line at allowing sexual deviants to be scoutmasters.

Allowing gay scouts is foolish because it risks exposing young teens to older teen males who have a sexual interest in other boys. Scouts usually camp two to a tent. Any parent in their right mind want to send their 13-year-old boy on one of those trips?

And it is foolish because it won't work, by which I mean it will buy them no goodwill from the Gay Gestapo whatsoever. The BSA only abandoned the sexual standards that had guided the organization since its founding out of craven capitulation to the deviancy cabal, which insisted on it as the price of admission to their version of polite society. But the move was destined to fail because the BSA didn't go the full Monty and allow homosexuals to serve as scoutmasters.

Their sop to the gay lobby was bound to please no one. And it didn't. Parents have been pulling their sons out of scouting so fast it'll give you a nosebleed, and BSA's cowardice prompted the formation of a pro-family alternative, Trail Life USA. And homosexual activists are outraged that the BSA offered them only half a loaf.

We've often made the point that nothing is ever enough for the gay lobby. You can only appease them by giving them every single solitary thing they want, and even that is not enough. They are like the leech described in Proverbs 30:15: "The leech has two daughters; 'Give,' and 'Give,' they cry." In the case of the BSA, the gay leeches demand that young boys be exposed to active homosexuals or they will make the BSA feel their wrath.

And so the Gay Gestapo has made a big-time move in California. The California Supreme Court Advisory Committee on the Code of Judicial Ethics is now proposing that any affiliation with the Boy Scouts disqualify any man from ever serving as a judge in the Golden State.

Yes, you read that right. If you happen to be a fan of sexual normalcy and want impressionable young teens to be protected from sexual predators, your professional career in the law will be over, perhaps before it has ever begun.

The Scouts are to be identified as a group that practices "invidious discrimination," which, of course, is exactly what the California Supreme Court would not only be practicing but celebrating with this new diktat. You can't get much more "invidious" than wrecking a man's career because he believes in protecting the sexual integrity of teenagers.

The new McCarthyite inquisitors demand to know, "Are you now, or have you ever been, affiliated with the Boy Scouts?"

The point of this new ban is to "enhance public confidence in the impartiality of the judiciary," according to the benighted and self-deceived souls on this committee. How exactly, one wonders, does one enhance confidence in "impartiality" by a blatant display of the worst kind of partiality imaginable?

This is Orwellian to an astonishing degree, a fact made more notable by the fact that the members of this committee seem fatuously oblivious to the reality that they are practicing the very sins they condemn. The Supreme Court, in the name of tolerance, would be terminating with extreme prejudice the judicial careers of anyone who does not hold pre-approved opinions about the wonders of sodomy.

Thus the Court, in a burst of wild-eyed and renegade activism, would violate every First Amendment right of every potential judge. Exercise your right to the free exercise of a religion that rejects homosexuality? Disqualified. Exercise freedom of speech by mentioning the health risks of homosexual behavior? Disqualified. Exercise freedom of the press by writing about the importance of man-woman marriage for the upbringing of children? Disqualified. Exercise freedom of association by hanging with an organization that wants sexually normal leaders? Disqualified.

"Invidious discrimination" is the mildest term that applies to such pig-headed, Nazi-esque tyranny.

California still has a chance as this proposal is coming from an "advisory" committee. This advisory committee should be forthwith advised that its proposal is headed to the nearest toxic waste dump where it belongs.

BULLIED BY THE POWER OF ONE

Should 1 Person have the Power to Overturn the Will of 3 Million Voters?

When our Founding Fathers established our nation, they purposely divided the power and responsibilities into three branches: legislative, executive and judicial.  Of the three branches, the judicial was supposed to be the branch with the most limited powers.  Our Founding Fathers never intended for judges to have the authority or power to overturn the will of the people.  They felt the people should have the say, not judges, not the president and not even Congress.  That’s why they started the US Constitution with the words ‘We the people of the United States.’  If they saw America today, they would wonder what happened to the country and government they created.

Years ago, the people of California and Arizona voted to make English the official language.  Hispanic minorities complained and took their whining to the courts.  In both states, the will of the people was overturned by one or three liberal judges who felt they had more power than the people.

This week, I saw the same thing happen just north of me in Ohio.  In 2004, Ohio voters passed a state constitutional amendment, Ohio State Issue 1 that banned same-sex marriage and civil unions.  The measure passed with 62% of the vote.

Naturally gay activists have been upset because the majority of Ohio citizens still believe that homosexuality is a sin as described in the Bible and should not be allowed.  They’ve been trying to challenge the constitutional amendment and will of the majority ever since.

BUYING FRIENDS FOR POLITICAL ACCESS

“Hillary For President” Fundraiser Busted For Illegal Campaign Contributions

(Zero Hedge) – If you listen carefully, you can hear the stampede of politicians distancing themselves from their once best-friend – Hotel magnate Sant Singh Chatwal – as AP reports, he plead guilty Thursday to charges he secretly funneled more than $180,000 in illegal campaign contributions to three unnamed candidates and coached someone to lie about it. Without the contributions “nobody will even talk to you,” Chatwal said. “That’s the only way to buy them, get into the system.” Welcome to the ugly truth of American politik.

The FT details that Sant Singh Chatwal, chairman of Hampshire Hotels Management, pleaded guilty on Thursday to making more than $180,000 in illegal federal campaign donations to three candidates through “straw donors” who were reimbursed, the DoJ said in a statement.

SPECIAL: Modern Day Patriots, this is the time to stand shoulder to shoulder with our forefathers in Lexington and Concord. We need the Tea Party now more than ever.

He raised at least $100,000 for Hillary Clinton in her 2008 presidential campaign against Barack Obama.

The justice department did not comment on whether Mrs Clinton was one of the three candidates, but it said there was no allegation that candidates took part in or were aware of Mr Chatwal’s scheme.

Mr Chatwal was skirting legal limits on contributions to an individual candidate’s campaign of $2,300 in 2008 and $2,400 in 2010.

As AP explains the fraud was extensive…

Court papers allege that between 2007 and 2011, Chatwal used his employees, business associates and contractors who worked on his hotels to collect contributions from straw donors in Queens, Long Island and elsewhere. He then arranged to pay the donors back, a violation of the election laws.

As part the scheme, an unnamed business associate submitted a bill to Chatwal for $104,745 in 2011 for purported work done for one of Chatwal’s companies. Prosecutors allege that $69,000 of the total actually was reimbursement for money the associate had raised via straw donors.

In a conversation recorded in 2012, Chatwal instructed the associate that if he were asked if Chatwal gave him the money back, he should respond, “Never.”

Chatwal directly backed several Democratic candidates with his own money — at least $31,200 since 2004, according to Federal Election Commission records.

Among them were New York Reps. Joe Crowley and Gary Ackerman, along with California Rep. Howard Berman and Florida Rep. Robert Wexler. He also gave money to Montana Sen. Jon Tester, Nevada Sen. Harry Reid, Connecticut Sen. Chris Dodd and Virginia Sen. Mark Warner.

And leaves the ugly truth of American politics behind…

An informant caught Sant Singh Chatwal on tape in 2010 explaining that he believed his illegal fundraising bought him access to people in power.

Without the contributions “nobody will even talk to you,” Chatwal said. “That’s the only way to buy them, get into the system.”

CRITICIZE ‘GAYS,’ GET SUED FOR ‘CRIME AGAINST HUMANITY’

What could be more boring to Americans than the latest news about a lawsuit brought by a group of political activists in Uganda? Especially since the case is currently in the mind-numbingly boring stage of endless interrogatories and depositions?

But this is no ordinary case.

The defendant, Pastor Scott Lively of Abiding Truth Ministries, says Americans need to be paying very close attention, because the outcome could well set a new precedent – that an international agenda based on anti-biblical standards could trump the U.S. Constitution’s freedom of speech and religion.

While the case’s current back-and-forth questions and answers will last another year, during which time an appellate court could intervene, Lively told WND the dispute is over whether a pastor can publicly criticize behavior that the Bible also criticizes.

U.S. District Judge Michael Posner has allowed to proceed a case brought against Lively by an African group called Sexual Minorities Uganda, or SMUG.

SMUG demands Lively be punished for criticizing homosexuality, calling his speech a “crime against humanity” in violation of “international law.” The plaintiffs allege the Alien Tort Statute in the United States allows them to make the charge in a U.S. court.

But Lively’s attorney, Horatio Mihet of Liberty Counsel, says his client’s preaching is protected by the Constitution.

“We believe SMUG’s claims are firmly foreclosed, not only by the First Amendment right to free speech, but also by the Supreme Court’s recent decision in Kiobel, which eliminated Alien Tort Statute claims for events that allegedly occurred in foreign nations,” he said.

Yet, Posner took nearly 80 pages to say that he thought SMUG’s allegations were substantive and needed to be adjudicated.

Appearing to side with the gay-rights plaintiffs, the judge writes that while SMUG is made up of groups “that advocate for the fair and equal treatment of lesbian, gay, bisexual, transgender and intersex (LGBTI) people,” Lively is an “American citizen residing in Springfield, Mass., who, according to the complaint, holds himself out to be an expert on what he terms the ‘gay movement.’”

Posner goes on to cite “many authorities” who “implicitly support the principle that widespread, systematic persecution of individuals based on their sexual orientation and gender identity constitutes a crime against humanity.”

Arguing that concluding Lively’s statements are protected under the First Amendment was “premature,” the judge further wrote: “Indeed, defendant, according to the amended complaint, is alleged to have maintained what amounts to a kind of ‘Homophobia Central” in Springfield. He has allegedly supported and actively participated in worldwide initiatives, with a substantial focus on Uganda, aimed at repressing free expression by LGBTI groups, destroying the organizations that support them, intimidating LGBTI individuals, and even criminalizing the very status of being lesbian or gay.”

Lively sought to have the complaint dismissed when the U.S. Supreme Court ruled, in Kiobel v. Royal Dutch Petroleum, that the Alien Tort Statute doesn’t apply to foreign territory and that the law cannot be used to challenge foreign conduct in courts in the United States.

Mihet sums up the heart of the case against Lively as being the belief that First Amendment free speech protections should play second fiddle to an international consensus that criticism of homosexuality is criminal.

Mihet told WND he has argued all along that the lawsuit was precluded by the First Amendment, which puts the U.S. Constitution higher than international law.

The case against Lively claims that by speaking his opinion in opposition to homosexuality, he was conspiring to deprive the plaintiffs of their fundamental rights. Mihet explained that although SMUG would allow people to express an opinion against homosexuality, if expressing that opinion causes anyone else to take any action, a crime might be committed.

Under that precedent, he said, someone petitioning in opposition to special designations for homosexuals would become an international human rights criminal. Likewise, those who worked to support Proposition 8 in California, the proposed state constitutional amendment limiting marriage to one man and one woman, would be subject to prosecution, he said.

It also would target those who are working to defeat the ENDA plan in Congress, which creates certain special protections for homosexuals in the workplace.

“All of those become criminals overnight under this theory of liability,” Mihat said.

Bottom line, SMUG’s attack on Lively goes directly to the supremacy and portability of the U.S. Constitution, say Lively’s attorneys.

“SMUG asks this United States court to punish one of its citizens, Mr. Lively, for ‘crimes against humanity’ under an international treaty that the United States has expressly rejected,” a court filing opposing SMUG’s case explained.

“Moreover, what SMUG cavalierly and conclusorily labels as ‘crimes against humanity’ – the most heinous of crimes – is actually nothing more than civil, non-violent political discourse in the public square on a subject of great public concern, which occupies the highest rung of First Amendment protection,” the brief said.

The extreme legal action was prompted by Lively “sharing his biblical views on homosexuality during a 2009 visit to Uganda.”

While there may have been some actions in Uganda against homosexuals, Liberty Counsel said, “SMUG alleges no plausible connection between Mr. Lively and the actual perpetrators of those alleged violent acts, and, indeed, Mr. Lively’s name is not mentioned one single time within the many pages of the complaint that describe those six events.”

SMUG is represented by the George Soros-funded Center for Constitutional Rights in New York, which the New York Times described as left-leaning.

“[The Alien Tort Statute] is not a blanket delegation of lawmaking to the democratically unaccountable international community,” said Mathew Staver, Liberty Counsel founder. “Like all American citizens, Rev. Lively enjoys a fundamental First Amendment right to engage in nonviolent political discourses anywhere in the world.”

In addition, Liberty Counsel contends the case against Lively has some glaring holes.

“SMUG also does not tell the court that David Kato – the murdered Ugandan activist whom SMUG makes the centerpiece of this lawsuit – was killed not by an enraged homophobe incited by Mr. Lively’s protected speech, but by a homosexual prostitute upset over a failed business transaction,” the organization said.

“Neither does SMUG tell the court that the confessed perpetrator of this horrible crime was tried and convicted in Ugandan courts, and is now serving a 30-year prison sentence.”

Finally, said Liberty Counsel SMUG “does not tell the court that, far from inciting violence, Mr. Lively has consistently condemned acts of violence and calls to violence in the strongest possible terms, and has praised the Ugandan courts for imparting justice.”
